The Air Resources Board (ARB) will release an updated staff
proposal regarding treatment of legacy contracts at 12:00 pm
(noon) Pacific Time on Wednesday, October 16, 2013. The proposal
will be posted on ARB's Cap-and-Trade page at:

Background
The Cap-and-Trade Regulation (Regulation) was formally adopted by
the Board in 2011. In regulation amendments currently available
for 45-day public comment to be considered by the Board at its
October hearing, ARB proposed to allocate allowances for free to
legacy contract generators for the first compliance period. The
Board will consider these amendments at its October 24-25th Board
hearing.
Staff is also proposing an updated amendment related to legacy
contracts, which will be posted at the time and date noted above.
If directed by the Board, the updated legacy contracts proposal
would be part of new regulatory amendments subject to a 15-day
notice of public availability and comment following the October
2013 Board hearing. Staff is making the legacy contracts
proposal available before the Board hearing to provide
stakeholders an opportunity to testify to the Board on the
concept at its October 2013 hearing. More information about the
