Cap-and-Trade Program—including dates, duties, and
obligations—that are pertinent to publicly owned utilities (POU).

BACKGROUND:

The California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Mechanisms Regulation (Cap-and-Trade Regulation) and
the revised Regulation for the Mandatory Reporting of Greenhouse
Gas Emissions (Mandatory Reporting Regulation) were adopted by
the California Air Resources Board in October 2011 and formally
went into effect January 1, 2012.

The Mandatory Reporting Regulation (MRR) requires first
deliverers of electricity to report greenhouse gas emissions from
electricity generation and imported electricity. Additionally,
MRR requires all retail providers to report California retail
sales. Under the Cap-and-Trade Regulation, first deliverers of
electricity will have an obligation to surrender compliance
instruments (allowances and offset credits) equal to their
emissions (as reported under MRR) to ARB. Allowances will be
freely provided by ARB to utilities. There are restrictions on
the use of allowance value. These details will be covered in the
webinar. Staff will also describe key dates and obligations that
utilities must meet to comply with the regulations, as well as
provide information about how utilities participate in the
program. This presentation is targeted at smaller POUs that may
not be familiar with the provisions of the Cap-and-Trade
Program.

arbcombo -- Workshop to Discuss Potential Revisions to the California Mandatory Greenhouse Gas Reporting Regulation - May 30th

The California Air Resources Board (ARB) staff will hold a
workshop on May 30, 2012, at 10 am to discuss potential
revisions to ARB's Regulation for the Mandatory Reporting of
Greenhouse Gas Emissions (title 17, California Code of
Regulations, sections 95100-95157)(Mandatory Reporting
Regulation).

The potential revisions would clarify requirements in several
sections of the regulation. Potential definition changes in the
Mandatory Reporting Regulation will also be discussed. To the
extent similar changes are required for the cap-and-trade
regulation or the cost of implementation fee regulation, those
changes may be proposed.

Update Asset-Controlling Supplier requirements: Clarify the
process for applying for Asset-Controlling Supplier status.
Add Process Emissions to Abbreviated Reporting: Include process
emissions as part of the reporting requirement for abbreviated
reporters.

Improve Product Data Requirements: Revise product data
requirements to clarify understanding of the use of financial
transaction data and product data verification requirements.
Revisions may also include modifications to ensure all data
required for allocation of allowances under the product-based
allocation methodology are reported.

Modify the Petroleum and Natural Gas Systems requirements:
Modify the Petroleum and Natural Gas Systems requirements in
order to include the December 2011 updates made by the United
States Environmental Protection Agency to their Final Rule on
Mandatory Reporting of Greenhouse Gases (title 40, Code of
Federal Regulations, Part 98), while maintaining the onshore
petroleum and natural gas production facility definition from
U.S. EPA's November 2010 rule. Revisions would ensure that
accurate calculation variables are included in ARB's regulation
to maintain sufficient rigor for the cap-and-trade program.
Revisions would also include corrections to typographical errors
in the U.S. EPA rule.

Improve the Metering Requirements: Add testing requirements to
demonstrate accuracy between calibrations.

Add requirements for Imported CNG and LNG fuel: Add reporting
requirements for imported compressed natural gas (CNG) and
liquefied natural gas (LNG) fuel suppliers.

Changes to Definitions: Make clarifying changes to definitions.
To the extent similar changes are required for the cap-and-trade
regulation or the cost of implementation fee regulation, those
changes may be proposed.

CAP AND TRADE TOPICS:
Leakage monitoring: collection of facility-level economic data
for timely monitoring of emissions leakage.

This workshop is intended to provide stakeholders an opportunity
to review staff thinking on potential revisions to the Mandatory
Reporting Regulation prior to the release of a 45-day, formal
rulemaking package. Staff is working to develop revised
greenhouse gas reporting requirements that would be brought
before the Board for consideration in September 2012.

arbcombo -- ARB ANNOUNCEMENT OF JUNE DATES FOR CAP-AND-TRADE OFFSET VERIFIER TRAINING

The Air Resources Board (ARB or Board), in collaboration with our
training partner Future Perfect, will conduct ARB offset verifier
training on June 18-22 and June 25-29 in Sacramento, California

.

BACKGROUND:
The California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Mechanisms Regulation was adopted by the California
Air Resources Board in October of 2011 and formally went into
effect January 1, 2012. Subarticles 13 and 14 of the regulation
describe the compliance offset program and the approval of Early
Action Offset Credits. Included in these subarticles is a
requirement for third-party verification of all GHG emission
reductions and GHG removal enhancements before any ARB offset
credits may be issued. Only ARB accredited offset verifiers may
provide offset verification services under the compliance offset
program. Accordingly, ARB has established a program to accredit
offset verifiers that meet the regulation's requirements.

To become an accredited offset verifier, the applicant must
submit a completed Verifier Application to ARB along with the
required documentation. Once the verifier applications have been
reviewed by ARB and determined to have the potential to meet the
minimum qualifications listed in the regulation, the verifier
applicant will be notified how to register for ARB approved
training courses.

ARB and Future Perfect will conduct training on June 18-22 and
June 25-29 in Sacramento, California. Future dates will be
announced when available.

Upon meeting the minimum qualifications listed in the regulation
the Executive Officer may accredit the offset verifiers.

arbcombo -- Public Consultation on Investment of Cap-and-Trade Auction Proceeds

California will be developing an investment plan for the auction
proceeds from the cap-and-trade program to reduce greenhouse
gases that contribute to climate change. As part of this
process, the California Air Resources Board (ARB) is hosting a
public consultation to solicit input from stakeholders and
experts on the development of the plan.

Representatives from the Administration and the Legislature have
been invited to hear from two panels of speakers, followed by

The Market Simulation Group (MSG) of the University of California
Energy Institute, working with the California Air Resources
Board, will hold a public meeting at the above time and location
to gather input from stakeholders that will inform an assessment
of design features of the California's cap-and-trade market for
greenhouse gas (GHG) emissions.

The MSG is in the process of constructing an emission allowance
market simulation model based on the market structure, current
market rules and other fundamental aspects of the state's GHG
emission market. The model will be used to examine the potential
for market power and other strategic behavior in the GHG
emissions market.

The objective of this meeting is to identify factors that can
potentially detract from the efficient and competitive operation
of the GHG emission market. There are three major topics for
discussion: (1) aspects of the market design that could detract
from market efficiency, (2) incentives market participants may
have to not comply completely with the market rules, and (3) the
effectiveness of mechanisms and process for monitoring market
performance and compliance with the market rules.

This meeting is meant to provide a forum for discussion between
the MSG team and interested stakeholders about these topics.
Stakeholders are asked to submit a brief, (no more than two
pages) written summary of specific scenarios or design elements
that may detract from market efficiency, create incentives for
participants to fail to comply with market rules, or reduce the
effectiveness of the market monitoring process. Written
summaries should be submitted electronically to
marketsimulationgroup@berkeley.edu no later than May 25, 2012.
All submitted comments will be publicly posted on May 30.

arbcombo -- May 24th Public Consultation Meeting on Investment of Auction Funds from California Cap-and-Trade Program

Please save the date for a public consultation meeting hosted by
the California Air Resources Board (ARB) on approaches for
investing auction proceeds from California's cap-and-trade
program. Panelists will discuss how California can most
effectively invest these funds to support the goals of Assembly
Bill 32 (AB 32) to reduce greenhouse gases, as well as encourage
long-term transformation to improve public health and develop a
clean energy economy. The public can share ideas about what
criteria and programs should be prioritized in the development of
an investment plan. ARB will soon be issuing a notice that
provides additional detail about the meeting and how to
participate.

BACKGROUND:

The Global Warming Solutions Act of 2006 (Chapter 488, Statutes
of 2006 [AB 32, Núñez/Pavley]), requires California to reduce
statewide greenhouse gas emissions to 1990 levels by 2020 and to
maintain and continue reductions beyond 2020. As part of this
effort, ARB has developed a cap-and-trade program. The program
establishes a statewide emissions limit on sources responsible
for 85 percent of greenhouse gases and creates a financial
incentive for investment in clean and efficient technologies.
Under the program, a portion of allowances required for
compliance will be auctioned. Strategic investment of auction
funds can further the purposes of AB 32 and deliver long-term
economic, environmental, and clean energy benefits. The first
auction is scheduled for November 2012 and auctions will be held
on a quarterly basis thereafter through 2020.

BACKGROUND:
The California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Mechanisms Regulation was adopted by the California
Air Resources Board in October 2011, and formally went into
effect January 1, 2012.

The Cap-and-Trade Regulation, along with the Regulation for the
Mandatory Reporting of Greenhouse Gas Emissions, has mechanisms
to determine the compliance obligation for electricity generators
and first jurisdictional delivers of electricity. These
regulations define the responsible party for imports, identify
appropriate uses for freely allocated allowances, identify the
compliance obligation for allowable sources of imported
electricity, and detail exemptions from a compliance obligation
for certain electricity transactions.

In Resolution 11-32, the Board directed ARB staff to work with
stakeholders and other state agencies on several issues related
to first jurisdictional deliverers of electricity. At this
workshop, staff will discuss the definition of "electricity
importer," resource shuffling, qualified export requirements and
calculation, and sales of electricity into the CAISO market.

The Air Resources Board (ARB or Board) has posted on its
Cap-and-Trade Program's Compliance Offset Program webpage
(http://www.arb.ca.gov/cc/capandtrade/offsets/offsets.htm)
application forms for approving Offset Project Registries and
Early Action Offset Programs and accrediting offset verifiers and
offset verification bodies

BACKGROUND:
The California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Mechanisms Regulation was adopted by the California
Air Resources Board in October of 2011 and formally went into
effect January 1, 2012. Subarticles 13 and 14 of the regulation
describe the compliance offset program and the approval of Early
Action Offset Credits. Included in these sections is a
requirement for third-party verification of all GHG emission
reductions and GHG removal enhancements before any ARB offset
credits may be issued. Only ARB accredited offset verifiers and
verification bodies may provide offset verification services
under the compliance offset program. Accordingly, ARB has
established a program to accredit offset verifiers and
verification bodies that meet the regulation's requirements. To
assist ARB in administering the compliance offset program, these
sections also include procedures for ARB to approve Offset
Project Registries and Early Action Offset Programs. These new
forms are designed to facilitate interested individuals and
entities in becoming accredited or approved.

To become an accredited offset verifier, the applicant must
submit a completed Verifier Application to ARB along with the
required documentation. To become an accredited offset
verification body, an interested entity must submit a completed
Verification Body Application to ARB along with the required
documentation. To become an approved Offset Project Registry, an
interested entity must submit a completed Offset Project Registry
Application to ARB along with the required documentation. If the
Registry applicant also wishes to become an approved Early Action
Offset Program, it must make one additional attestation in Part
IV of the Offset Project Registry Application.

Once the verifier and Offset Project Registry applications have
been reviewed by ARB and determined to have the potential to meet
the minimum qualifications listed in the regulation, the verifier
applicant or registry staff will be notified of the dates and
locations of ARB approved training courses.

Upon meeting the minimum qualifications listed in the regulation
the Executive Officer may accredit the offset verifiers and
offset verification body applicants and approve the Offset
Project Registry and Early Action Offset Program applicants.
