BACKGROUND:
The California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Mechanisms Regulation was adopted by the California
Air Resources Board in October 2011, and formally went into
effect January 1, 2012.
The Cap-and-Trade Regulation, along with the Regulation for the
Mandatory Reporting of Greenhouse Gas Emissions, has mechanisms
to determine the compliance obligation for electricity generators
and first jurisdictional delivers of electricity. These
regulations define the responsible party for imports, identify
appropriate uses for freely allocated allowances, identify the
compliance obligation for allowable sources of imported
electricity, and detail exemptions from a compliance obligation
for certain electricity transactions.
In Resolution 11-32, the Board directed ARB staff to work with
stakeholders and other state agencies on several issues related
to first jurisdictional deliverers of electricity. At this
workshop, staff will discuss the definition of "electricity
importer," resource shuffling, qualified export requirements and
calculation, and sales of electricity into the CAISO market.
