hdghg -- Tractor-Trailer Greenhouse Gas Regulation Registration Deadline for Large Trailer Fleets to be Extended

The California Air Resources Board (ARB) has issued Advisory MSC
11-39 to notify stakeholders that ARB is extending the
registration and first year compliance deadlines for Option 2 of
the Large Fleet Compliance Plan to a future date that will be
determined through an upcoming regulatory process. This extension
would provide fleets that have not already registered to use a
compliance option under the regulation to participate in Option 2
of the Large Fleet Compliance Plan.

Background
The Tractor-Trailer Greenhouse Gas Regulation (Regulation)
applies to 53-foot or longer dry van or refrigerated van trailers
(box-type trailers) and the tractors that pull them on California
highways. The Regulation requires tractor-trailers operating in
California to use tractors and box-type trailers that utilize
certain aerodynamic equipment and low rolling resistance tires,
as verified by the U.S. Environmental Protection Agency SmartWay
program, to meet specified fuel efficiency improvements.

The regulation establishes specific compliance deadlines for
trailers based on fleet size and model year. Specifically, large
fleets (with 21 or more trailers) may either:
• Bring all their pre-2011 model year trailers into compliance by
January 1, 2013, or
• Phase-in compliance over several years, if they registered by
the registration deadline. Two phase-in options were available:
o Option 1 allowed a six year phase-in (from 2010 through 2015),
if large fleets registered by July 1, 2010
o Option 2 allowed a five year phase-in (from 2011 through 2015),
if large fleets registered by July 1, 2011

arbcombo -- Office of Administrative Law Approves Californias Cap-and-Trade and Mandatory Greenhouse Gas Reporting Regulations

California's Office of Administrative Law (OAL) has approved the
California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Regulation, including Compliance Offset Protocols.

The regulation is effective January 1, 2012. The version approved
by OAL removed several 'reserved' sections (that is, sections
that referenced future regulatory elements that have not yet been
approved) in the regulation to conform to rulemaking requirements
under the Administrative Procedure Act. The removal of
'reserved' sections does not reflect policy decisions on whether
those areas will or will not be addressed in future rulemakings.
Staff will continue to engage with stakeholders on issues
identified in Resolutions 10-42 and 11-32.

ARB has updated its cap-and-trade program webpages to provide
information related to program implementation. These webpages
will be updated regularly as implementation guidance and systems

OAL has also approved the Mandatory Reporting of GHG Emissions
Regulation. The regulation includes amendments to harmonize the

arbcombo -- Truck and Bus Regulation Online Reporting is Now Available

The online reporting system for the Truck and Bus regulation is
now available at:

note that fleets which must report have until January 31, 2012 to
complete their reporting. Please refer to the Truck and Bus
Regulation User Guide at
http://www.arb.ca.gov/msprog/onrdiesel/documents/tbuserguide.pdf
for more information on how to report. There is no cost to
report.

Please be aware that the reporting requirements for fleets differ
by gross vehicle weight rating (GVWR). Specifically:

HEAVIER VEHICLES (GVWR more than 26,000 lbs)

- No reporting is required for diesel truck owners that comply
with the engine model year schedule and do not plan to use
credits, and extensions. A fact sheet with the compliance
requirements summary is available at

- Fleets that report by January 31, 2012 will have more
flexibility to bring heavier vehicles into compliance.

- Small fleets with three or fewer diesel vehicles must report
all heavier trucks now if any have 1996 to 1999 model year
engines of if you are an owner operator with a heavier
low-mileage construction truck. Otherwise, you may wait until
next year to report.

LIGHTER VEHICLES (14,001 to 26,000 lbs)

- No reporting is required, as clean-up requirements do not
begin until January 1, 2015.

Note that publicly and privately owned school buses have
different clean-up requirements than other vehicles and do not
need to be reported.

Background

On December 11, 2008, the Board approved for adoption the Truck
and Bus regulation to control emissions from nearly all existing
diesel powered heavy-duty trucks and buses operating in
California. The regulation became effective under California law
on January 8, 2010. The regulation applies to diesel fueled
trucks and buses with a gross vehicle weight rating (GVWR)
greater than 14,000 pounds that are privately owned, federally
owned, and to publicly and privately owned school buses. Local
and state government owned diesel fueled trucks and buses are
already subject to other ARB regulations. Reducing emissions from
in-use trucks and buses is necessary to meet federally imposed
clean air standards and to reduce the adverse health effects from
truck and bus pollution.

On December 17, 2010, the staff recommended amendments, which are
presently pending adoption, that would delay the initial
requirement to install particulate matter (PM) retrofit filters
by one year to January 1, 2012 and extend the time before a
vehicle equipped with a PM filter would have to have an engine
that meets 2010 model year emission standards. The amendments
also defer engine replacements for vehicles without PM filters
for two years until January 1, 2015. Prior to 2020, replacements
are limited to 20 year old or older trucks that are not equipped
with PM filters. By January 1, 2023, most vehicles will need to
be equipped with an engine meeting 2010 model year emission
standards.

arbcombo -- Posting of Emission Factors for Commercial Recycling

On October 21, 2011, ARB staff, in coordination with CalRecycle
staff, presented to the Board an update on the staff's work on
commercial recycling and the requirements outlined in Assembly
Bill (AB) 341. AB 341 gives CalRecycle authority to implement a
commercial recycling program, for which CalRecycle has initiated
a new rulemaking process on October 28, 2011. For more

Also during the October 21, 2011 meeting, the Board directed
staff to continue our collaboration with CalRecycle to ensure the
commercial recycling program's successful implementation. One
component of this collaboration is that ARB is responsible for
the development and the updating of California specific emission
reduction factors for recycled materials. These factors are used
in estimating GHG emission reductions from recycled materials.
