arbcombo -- Cap-and-Trade Program allowance allocation-related forms now available

The California Air Resources Board (ARB) has made available new
and updated forms for allocation distribution for publicly owned
utilities, electrical cooperatives, and natural gas suppliers;
applications for legacy contract transition assistance;
notifications of intent to receive allocation as a public service
facility; and applications for a limited exemption from the
production of qualified thermal output.

The new forms reflect amendments to the Cap-and-Trade Regulation
(Regulation) that went into effect July 1, 2014. All of these
forms and the notice of intent are provided for clarity and
convenience and do not supersede any law or regulation.

An updated "Publicly Owned Utility or Electricity Cooperative
Allocation Distribution Form," updated "Publicly Owned Utility or
Electrical Cooperative Allowance Recipient Confirmation Form,"
and new "Natural Gas Supplier Allocation Distribution Form" are
available at

The information contained in all of these forms is due to ARB by
September 2, 2014, for allocation of vintage 2015 allowances.

Legacy contract generators may use the newly available "Legacy
Contract Transition Assistance Application Form" to request
transition assistance for the greenhouse gas emissions associated
with legacy contracts. The information contained in this forms
is due to ARB by September 2, 2014, for allocation of vintage
2015 allowances. This form is available under the "Other Types
of Allocation and Limited Exemptions" section of the Allowance
Allocation web page

Public service facilities may use the newly available "Notice of
Intent to Receive Allocation as a Public Service Facility" to
inform ARB of their intent to receive transition assistance. We
request that the information contained in this form be received
by ARB no later than September 2, 2014, for requests for
allocation of vintage 2015 allowances. This notice of intent is
available under the "Other Types of Allocation and Limited
Exemptions" section of the Allowance Allocation web page

Cogeneration units which would not exceed the Cap-and-Trade
Program inclusion threshold but for their thermal output produced
on site, and district heating facilities that serve multiple end
users, none of which would be covered under the Cap-and-Trade
Program if they produced the emissions currently produced by the
district heating facility in the process of serving that end
user, may use the newly available "Application for Limited
Exemption of Emissions from Qualified Thermal Output" to apply
for a limited exemption of emissions. This notice of intent is
available under the "Other Types of Allocation and Limited
Exemptions" section of the Allowance Allocation web page

BACKGROUND:

The California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Mechanisms Regulation (Regulation) was adopted by the
California Air Resources Board in October of 2011, and formally
went into effect January 1, 2012. Entities subject to the
Regulation will have a compliance obligation for their greenhouse
gas emissions beginning on January 1, 2013. The Regulation was
amended in early 2013 to link the California and Québec programs
beginning January 1, 2014, and again on July 1, 2014 to provide
additional and revised transition assistance for covered
entities, to incorporate additional cost containment mechanisms,
to make technical amendments to help with program implementation,
and to further enable market oversight.
