arbcombo -- January 15, 2016 ARB Public Workshop on the Scoping Plan Economic Analysis and Potential Updates to GHG Emissions Inventory Methods

Air Resources Board (ARB or Board) staff invites you to
participate in a public workshop on January 15, 2016, to discuss
the economic analysis of the 2030 Target Scoping Plan Update
(Update) including the use of E3's California PATHWAYS model and
the REMI PI+ model for evaluation of potential policies for the
Update. The role of the Scoping Plan Economic Reviewers will
also be discussed. Prior to the Scoping Plan Update related
discussions, the day will begin with a presentation of potential
updates to the state's greenhouse (GHG) emission inventory
methodology.

This workshop is part of the public process to update the Scoping
Plan to reflect the Governor's Executive Order B-30-15, which
establishes a mid-term GHG reduction target for California of 40
percent below 1990 levels by 2030. All state agencies with
jurisdiction over sources of GHG emissions were directed to
implement measures to achieve reductions of GHG emissions to meet
the 2030 and 2050 targets. ARB was directed to update the AB 32
Scoping Plan to reflect the 2030 target, and therefore, is moving
forward with the update process.

Presentations will include a high-level overview of the modeling
tools that will be used to evaluate the economic impact of
policies that may be proposed to help achieve the 2030 target.
Presentations will also include an outline of the California
PATHWAYS model, including model inputs and outputs, and a
preliminary list of policies to be considered in the Reference
Scenario.

The workshop will also include an introduction to the economic
reviewers for the 2030 Target Scoping Plan Update. The
discussion will include information on the role, tasks, and
timeline for the economic reviewers. The economic reviewers may
provide initial thoughts on the tools and methods proposed for
the economic modeling and evaluation for the 2030 Target Scoping
Plan Update.

Staff will also discuss potential updates to the State's GHG
inventory methodology. These potential updates may include
changes to the treatment of biofuels and other sources to better
align the inventory methods with changes to national and
international accounting methods.

Background

Scoping Plan

In 2006, the Legislature passed the California Global Warming
Solutions Act of 2006 (Assembly Bill 32 [AB 32]; Stats. 2006,
chapter 488). AB 32 created a comprehensive, multi-year program
to reduce GHG emissions in California. AB 32 required ARB to
develop and approve a Scoping Plan that describes the approach
the State will take to reduce GHGs to achieve the goal of
reducing emissions to 1990 levels by 2020.

The Scoping Plan was first approved by the Board in 2008 and, per
AB 32, must be updated every five years to evaluate the mix of AB
32 policies to ensure that California is on track to achieve the
2020 GHG reduction goal. The 2013 First Update to the Climate
Change Scoping Plan defined ARB's climate change priorities for
the next five years and laid the groundwork to start the
transition to the post-2020 goals set forth in Executive Orders
S-3-05 and B-16-2012. The 2013 Update also recommended the need
for a 2030 mid-term target to establish a continuum of action to
reduce emissions, not just for stated limits in 2020 or 2050, but
also in between.

The 40 percent below 1990 levels mid-term target set by Executive
Order B-30-15 is critical to help frame the additional suite of
policy measures, regulations, planning efforts, and investments
in clean technologies and infrastructure needed to continue
driving down emissions.

Greenhouse Gas Emission Inventory Program

The Global Warming Solutions Act of 2006 (AB 32) requires that
the California Air Resources Board (ARB) determine the statewide
1990 greenhouse gas (GHG) emission level and approve a statewide
greenhouse gas emissions limit, equal to the 1990 level, to be
achieved by 2020. Assembly Bill 1803, which became law in 2006,
made ARB responsible to prepare, adopt, and update California's
greenhouse gas inventory.

On Thursday, January 7, 2016, at noon (Pacific), the linked
California and Québec Cap-and-Trade Programs will release an
updated Compliance Instrument Report. At the beginning of each
calendar quarter, the California Air Resources Board (ARB) and
Québec's ministère du Développement durable, de l'Environnement
et de la Lutte contre les changement climatiques (MDDELCC)
publish an updated Compliance Instrument Report summarizing the
number of compliance instruments held by entities in the linked
California and Québec Cap-and-Trade Programs. This report is
typically updated and published on the second business day of
each calendar quarter, and is based on information pulled from
the Compliance Instrument Tracking System Service (CITSS) as of
9am (Pacific) and noon (Eastern) two business days prior to the
posting date.

With the linked programs, California and Québec must coordinate
postings of public information taking into account both
jurisdictions' holiday schedules. For Québec, January 4, 2016
is
a holiday. As such, ARB and MDDELCC will pull data from CITSS
on
January 5, 2016, and post the updated Compliance Instrument
Report on January 7, 2016.

arbcombo -- January 6, 2016: Environmental Justice Advisory Committee Meeting Webinar

The AB 32 Environmental Justice Advisory Committee (EJAC) will be
meeting via webinar on January 6, 2016 from 10:00 am to 11:30 am
(PST). Participants may attend via webinar or at any of the

Room, 2nd floor of the Cal/EPA Headquarters Building, located at

Background:

The California Global Warming Solutions Act of 2006, (AB 32 calls
for the Air Resources Board (ARB or Board) to convene a global
warming environmental justice advisory committee (EJAC), to
advise the Board in developing the Scoping Plan, and any other
pertinent matter in implementing AB 32. The advisory committee
is comprised of representatives from communities in the State
with the most significant exposure to air pollution, including,
but not limited to, communities with minority populations or
low-income populations, or both.

The Board appointed the first EJAC to advise it on the Initial
Scoping Plan and other climate change programs. To advise the
Board on the First Update to the Climate Change Scoping Plan, ARB
reconvened a new EJAC on March 21, 2013.

To replace members that either changed positions and had to
resign from the Committee or were unable to serve, the Board
appointed four new members on September 25, 2015. The EJAC will
advise the Board on the development of the 2030 Target Scoping
Plan, per Governor Brown's Executive Order B-30-15.

Committee meetings are open to the public and include a public
comment period.

arbcombo -- Public Information Release of First Cap-and-Trade Compliance Period Report and Market Transactions Reports to be Posted on Dec. 16, 2015

The California Air Resources Board (ARB) will make available two
new reports on Cap-and-Trade Program activity on December 16,
2016 at noon (12:00 PM) Pacific Time. The first report provides
a detailed summary of covered entity compliance status for the
first compliance period (2013-2014) of the California
Cap-and-Trade Program. The second report is the Summary of
Transfers Registered in CITSS by California and Québec Entities
in 2014, which provides details on the number of completed
transfers, the quantity of compliance instruments transferred
between market participants, and the weighted average prices of
the transfers.

BACKGROUND:

The California Cap on Greenhouse Gas Emissions and Market-Based
Compliance Mechanisms Regulation (Regulation) was adopted by the
California Air Resources Board in October of 2011, and formally
went into effect January 1, 2012. Entities subject to the
Regulation have a compliance obligation for their greenhouse gas
emissions beginning on January 1, 2013. The Regulation was
amended in early 2013 to link the California and Québec programs
beginning January 1, 2014.

The first compliance period status report will contain a detailed
list of covered entities and a tabulation of the compliance
instruments they submitted to meet their obligations for the
first compliance period. On November 4, 2014, covered entities
were required to surrender compliance instruments to cover 30% of
their 2013 emissions. ARB published a report for 2013 compliance
at:

On November 2, 2015, covered entities were required to surrender
compliance instruments to cover the remaining 70% of their 2013
emissions, and 100% of their 2014 emissions. For this compliance
surrender, both vintage 2013 and 2014 allowances were eligible
for compliance use. Covered entities also may have used offset
credits up to the quantitative usage limit specified in section
95854 of the Regulation (up to eight percent). Future vintage
year allowances generally could not be used to satisfy the first
compliance period obligation, with the limited exception of
certain entities who have received 2015 and 2016 true-up
allowances as described in section 95894 of the Regulation.

The second data report tabulates the transfers of compliance
instruments made through the Compliance Instrument Tracking
System Service (CITSS) in 2014. For transfers of allowances, the
table provides a breakdown by vintage and whether the transfer
was priced or unpriced. Most transactions between independent
market participants, such as bilateral transactions or
transactions cleared on the Intercontinental Exchange (ICE), are
conducted at a price that is entered into the transfer request in
CITSS. However, there are numerous transactions made without an
explicit price. These include, for example, transfers between
corporate associates, between an electric distribution utility
and a generator as part of a power purchase agreement, between
publicly-owned utilities, or as part of an agreement that
transfers compliance instruments with other products. The table
contains a separate accounting of transfers of offsets, again
with a breakdown between priced and unpriced transfers. Offsets
transfers are further broken down by project type.

arbcombo -- ARB will release an update of estimates of State-owned allowances available for auction on December 4, 2015, at 12:00 pm

On December 4, 2015, at 12:00 pm, the Air Resources Board (ARB)
will release an update of the estimates of the total State-owned
allowances that will be offered at auctions through 2020 under
the Cap-and-Trade Program. These estimates are for State-owned
allowances only and do not include estimates of allowances
consigned for sale by utilities from their electricity or natural
gas allocation.

Background

Under the Cap-and-Trade Program, emissions caps and associated
greenhouse gas (GHG) allowance budgets are calculated for each
calendar year. In the Cap-and-Trade Program, the calendar year
from which the allowances are assigned is referred to as the
"budget year." California GHG allowances are sold at one of four
quarterly auctions held by ARB each year in February, May,
August, and November. Proceeds from State-owned allowances sold
in the quarterly auctions are deposited into the Greenhouse Gas
Reduction Fund.

The estimates of total State-owned allowances will be accessible
via ARB's Cap-and-Trade website at:

website will contain additional information on the assumptions
used for estimating State-owned allowances as well as additional
information on the Cap-and-Trade Program.

arbcombo -- Cap-and-Trade Auction Proceeds: A revised draft of the Second Investment Plan for California Climate Investments is now available.

The Revised Draft Second Investment Plan for Fiscal Years 2016-17
through 2018-19 is available. Information can be found at:

To guide the investment of Cap-and-Trade auction proceeds, the
Department of Finance, in consultation with the Air Resources
Board and other State agencies, is required to submit a three
year Investment Plan to the Legislature that identifies
investments to help California achieve its greenhouse gas
reduction goals, while realizing additional health, economic, and
environmental benefits. The Investment Plan does not propose any
specific funding levels or percentage allocations–those decisions
are made by the Legislature in the annual State Budget process.

The Revised Draft Second Investment Plan is now available and
will be presented at the December 17, 2015 Board hearing. At the
Board hearing, staff will provide an overview of the draft
recommendations presented in the document.

Written comments are due by December 14, 2015. Public feedback
received at the Board hearing and in writing will inform the
preparation of the final Second Investment Plan, which is due to
the Legislature in January 2016.

BACKGROUND:
Assembly Bill 32, the California Global Warming Solutions Act of
2006 (AB 32; Nunez, Chapter 488, Statutes of 2006) is a
comprehensive, multi-year program to reduce greenhouse gas
emissions in California. The Air Resources Board has adopted a
Scoping Plan and, together with other State and local agencies,
has developed and implemented numerous regulations and programs,
including the Cap-and-Trade Program to reduce emissions to meet
AB 32 goals.

arbcombo -- Dec 14: Public Workshop on CA Plan for Compliance with the Clean Power Plan and Potential 2016 Amendments to the Cap-and-Trade Program

Air Resources Board (ARB or Board) staff invites you to
participate in a public workshop on December 14, 2015, to discuss
California's plan for compliance with the U.S. Environmental
Protection Agency's (U.S. EPA's) Clean Power Plan, and the scope
and regulatory schedule for potential amendments to the
Cap-and-Trade Regulation (Regulation or Program) relating to
electricity sector emissions.

This workshop is part of the public process to develop the
State's Clean Power Plan compliance proposal and 2016 amendments
to the Cap-and-Trade Regulation related to the electricity
sector.

Staff will present policy options and modeling results and seek
stakeholder input regarding California's potential strategy for
Clean Power Plan compliance. The staff presentation will include
initial approaches and results for electricity sector carbon
emissions analysis consistent with the Clean Power Plan, and
options for continued analysis, as well as initial discussion for
how California's compliance plan may interact with regional
electricity and carbon markets.

Staff will also discuss potential modifications to the Cap and
Trade and Mandatory Greenhouse Gas Reporting Regulations,
including modifications which may be effective in the post-2020
Program, and to permitting programs, which may be proposed in
2016 to enable Clean Power Plan compliance. Staff anticipates
that the Cap-and-Trade Regulation will play a large role in the
Clean Power Plan compliance plan. These amendments may include
changes to reporting and verification deadlines, compliance
periods, changes needed to address federal plan "backstop"
requirements, and treatment of imported electricity. A staff

Staff will also present Cap and Trade Regulation goals for the
upcoming amendment process and seek input from stakeholders on
potential Regulation amendments that will apply to the Program's
third compliance period and to the post 2020 Program. Third
compliance period amendments to be discussed by staff at this
meeting will include changes to the Renewable Portfolio Standard
adjustment for compliance obligations. Staff does not plan to
discuss proposals for post 2020 electrical distribution utility
allocation until early 2016.

Finally, staff will discuss potential amendments or processes
related to the electricity sector including the recent mandates
of SB 350 for the electricity sector.

Environmental Analysis

Pursuant to the California Environmental Quality Act (CEQA) and
ARB's Certified Regulatory Program (Cal. Code Regs., tit. 14,
§15251(d); Cal. Code Regs., tit. 17, §§ 60000–60008), staff is
reviewing the Clean Power Plan and Cap and Trade Regulatory
Amendments to determine if the proposed project will result in
any potentially significant adverse environmental impacts. An
environmental analysis (EA) will be released for a 45-day public
review and comment period with the proposed Clean Power Plan and
Cap and Trade Regulatory Amendments to be released in the spring.
Comments received at this public workshop will be considered
when preparing the CEQA document.

Background

Cap-and-Trade Regulation

The Board first formally adopted the Regulation in October 2011,
and subsequently approved limited amendments to the Regulation in
June 2012, October 2013, April 2014, September 2014, and most
recently June 2015. The upcoming 2016 amendments will seek to
improve Program efficiency, update the Regulation using the
latest information, and chart post-2020 implementation of the
Program.

Clean Power Plan

On August 3, 2015, U.S. EPA's Administrator signed its Clean
Power Plan, which sets carbon dioxide emissions limits for many
existing electric generating units. These regulations are based
on section 111(d) (42 U.S.C. § 7411(d)) of the federal Clean Air
Act. The Plan was published in the Federal Register on October
23, 2015. States must develop compliance plans to meet these
limits and compliance plans are due in September 2016 (with the
option to seek extensions). ARB is developing California's
compliance plan in consultation with the California Energy
Commission and the California Public Utilities Commission,
California's air districts, and other partners.
