arbcombo -- ARB releases the draft Short-Lived Climate Pollutant Reduction Strategy

The Air Resources Board (ARB or Board) has released, for public
review, a draft Short-Lived Climate Pollutant Reduction Strategy
(Draft Strategy).

Short-lived climate pollutants (SLCPs) include methane, black
carbon, and fluorinated gases. They are powerful climate forcers
that remain in the atmosphere for a much shorter period of time
than longer-lived climate pollutants, including carbon dioxide.
Their relative potency, when measured in terms of how they heat
the atmosphere, can be tens to thousands of times greater than
that of carbon dioxide. Senate Bill 605 (Lara, Chapter 523,
Statutes of 2014) requires ARB, in coordination with other state
agencies and local air districts, to develop a SLCP Strategy by
the end of 2015, to reduce SLCP emissions in California.

The Draft Strategy describes ongoing and potential new measures
to reduce SLCP emissions from major sources in the State, and
describes current and future research needs for improving the
SLCP emission inventory and better understanding potential
mitigation measures.

The Draft Strategy will be discussed at public workshops in
October. Comments received on the Draft Strategy will inform
the development of a Proposed Strategy, which will be will
presented to the Board in late 2015. ARB welcomes broad
participation of stakeholders, experts, and interested parties
throughout this process.

As previously noticed, the California Environmental Protection
Agency, California State Transportation Agency, California Energy
Commission, California Public Utilities Commission, California
Natural Resources Agency, California Department of Food and

Planning and Research will hold a public workshop on October 1,
2015, to discuss the updated AB 32 Scoping Plan, which will
reflect California's new goal to reduce greenhouse gas emissions
40 percent below 1990 levels by 2030, as directed in Executive

Cap-and-Trade Regulation (Regulation) and California's plan for

Purpose of Workshop

This workshop will commence the public process to develop 2016
amendments to the Cap-and-Trade Regulation and Clean Power Plan
compliance effort, and it will include ARB staff presentations on
three topics: (1) general Cap-and-Trade Regulation amendments,
(2) cost-containment and market oversight provisions, and (3)
California's plan for compliance with the U.S. EPA Clean Power
Plan, issued under the federal Clean Air Act.

First, staff will present general goals for the upcoming
amendment process and seek input from stakeholders on potential
Regulation amendments that will apply to the Program's third
compliance period and to the post-2020 Program. Amendments
impacting the Program in the third compliance period are expected
to address the following areas: streamlining offsets, auctions,
and management of information in the Compliance Instrument
Tracking System Service (CITSS); updating leakage prevention in
response to emissions leakage studies; and including sector-based
offset credits. Potential amendments for the post-2020 Program
include the general Program scope, the post-2020 cap, Program
linkage, allowance allocation, and the Program's plan for
compliance with the U.S. EPA 111(d) rule. Revisions to other
areas of the Regulation will be considered to clarify language.


Second, staff will present on cost-containment and market
oversight provisions and seek input from stakeholders on possible
amendments.

Third, staff will present on initial thinking and options for
California's Clean Power Plan compliance plan, focusing on
potential interactions with the Cap-and-Trade Regulation, which
staff anticipates will play a large role in the compliance plan.
A staff white paper on these issues will be available before the
workshop.


The expected schedule for the October 2 workshop is as follows:

Background

Cap-and-Trade Regulation

ARB first formally adopted the Regulation in October 2011. The
Board has subsequently approved limited amendments to the
Regulation in June 2012, October 2013, April 2014, September
2014, and most recently June 2015. The upcoming 2016 amendments
will seek to improve Program efficiency and chart post-2020
implementation of the Program.

Clean Power Plan

On August 3, 2015, U.S. EPA's Administrator signed its Clean
Power Plan, which sets carbon dioxide emissions limits for many
existing electric generating units. These regulations are based
on section 111(d) (42 U.S.C. § 7411(d)) of the federal Clean Air
Act. States must develop compliance plans to meet these limits
and compliance plans are due in September 2016 (with the option
to seek extensions). ARB is developing California's compliance
plan in consultation with the California Energy Commission and
the California Public Utilities Commission, California's air
districts, and other partners.

Background

In 2006, the Legislature passed the California Global Warming
Solutions Act of 2006 (Assembly Bill 32 [AB 32]; Stats. 2006,
chapter 488). AB 32 created a comprehensive, multi-year program
to reduce GHG emissions in California. AB 32 required ARB to
develop and approve a Scoping Plan that describes the approach
the State will take to reduce GHGs to achieve the goal of
reducing emissions to 1990 levels by 2020.

The Scoping Plan was first approved by the Board in 2008 and, per
AB 32, must be updated every five years to evaluate the mix of AB
32 policies to ensure that California is on track to achieve the
2020 GHG reduction goal. The 2013 First Update to the Climate
Change Scoping Plan defined ARB's climate change priorities for
the next five years and laid the groundwork to start the
transition to the post-2020 goals set forth in Executive Orders
S-3-05 and B-16-2012. The 2013 Update also recommended the need
for a 2030 mid-term target to establish a continuum of action to
reduce emissions, not just for stated limits in 2020 or 2050, but
also every year in between.

The 40 percent below 1990 levels mid-term target set by Executive
Order B-30-15 is critical to help frame the additional suite of
policy measures, regulations, planning efforts, and investments
in clean technologies and infrastructure needed to continue
driving down emissions.

Workshop Materials

An agenda and presentation material will be made available prior
to the public meeting. Additional regional workshops are being
planned for Los Angeles, the Central Valley, and the Bay Area in
the fall. Details will follow. The meeting materials can be

cc -- Submission of Modified Cap-and-Trade Program Regulatory Language and Protocols to the Office of Administrative Law

On Tuesday, September 8, 2015, the Air Resources Board (ARB or
Board) staff submitted the Board-adopted modifications to the
Cap-and-Trade Regulation (Regulation) as well as the updated U.S.
Forest (Forest Protocol) and new Rice Cultivation (Rice Protocol)
Compliance Offset Protocols to the Office of Administrative Law
(OAL) for review and approval. Once approved, filed with the
Secretary of State, and published in the California Code of
Regulations, the modified Regulation and protocols will become
effective. ARB has requested an early effective date for the
Regulation and protocols of November 1, 2015; this request is
subject to OAL approval.

Once effective, rice projects will be eligible for listing under
the new Rice Protocol and all new forest projects must list under
the June 25, 2015, updated version of the Forest Protocol.
Existing forest projects will be eligible to update to the June
25, 2015, version of the Forest Protocol as well.

Background
At its December 18, 2014, public hearing, the Board considered
the Staff Report: Initial Statement of Reasons released on
October 28, 2014, and adopted Resolution 14-44, which directed
staff to consider the comments submitted during the rulemaking
and make appropriate modifications. The Board directed the
Executive Officer to make the modified regulatory language, and
any additional conforming modifications, available for public
comment, with any additional supporting documents and
information, for a period of at least 15 days as required by
Government Code section 11346.8. The Board further directed the
Executive Officer to consider written comments submitted during
the public review period and make any further modifications that
are appropriate available for public comment for at least 15
days, and present the Regulation to the Board for further
consideration.

On May 20, 2015, after reviewing public comments and meeting with
interested stakeholders, staff released a Notice of Public
Availability of Modified Text and Availability of Additional
Documents in response to Board direction at the December 2014
hearing and Resolution 14-44.

At a public hearing held on June 25, 2015, the Board approved
Resolution 15-19, approving the written responses to
environmental comments, making required California Environmental
Quality Act and other findings, and adopting the final regulatory
amendments, including the Rice Cultivation Projects and U.S.
Forest Projects Compliance Offset Protocols. The Resolution also
directed the Executive Officer to finalize the Final Statement of
Reasons (FSOR) for the regulatory amendments and to submit the
final rulemaking package to the Office of Administrative Law for
review. The FSOR provides written responses to all comments
received on the proposed amendments during the 45-day and 15-day
comment periods, during the December 18, 2014, Board hearing, and
during the final June 25, 2015, Board hearing.

On September 8, 2015, ARB submitted all regulatory documents to
OAL for review. OAL has 30 calendar days, ending October 20,
2015, to make its determination.
